The Government has finally published its new Procurement Bill setting out the new legal framework for public procurement. This new framework will replace the current Public Contracts Regulations 2015, as well as replacing the separate Regulations on defence, utilities and concessions.
Most of us are familiar with the Government’s plans as set out in its Response to the procurement Green Paper. But how does the Bill compare with those plans? Does it live up to expectations? Does it throw up any surprises? What does it cover and what does it omit? Importantly, can we expect any changes to the Bill before it is enacted? And what is the likely timescale for the legal changes?

Professor Sue Arrowsmith QC (hon), is Professor Emerita at the University of Nottingham, where she was formerly Achilles Professor of Public Procurement Law and Policy. She has been instrumental in reforming public procurement rules and was a member of the UK Government’s Procurement Transformation Advisory Panel, advising on post-Brexit procurement reform. She is currently a member of its Thematic Working Group on Procurement advising on public procurement rules in trade agreements.
